OK, who is Shane Chambers and what makes him think he can charge money for a picture of me without having asked permission to take, use or sell the image? If this were for charity, like Carie is doing, then fine, no problems. Otherwise, it's very offensive. The more I think about this, the more it pisses me off, especially the nerve of the guy to put HIS copyright on MY image without obtaining permission. The site even tries to block saving the image (use a screen shot to capture them if you want them, screw him.) Time for an email...

Anyone know the legal info concerning this?

Personally, I am not to happy about this and plan on bringing it up with Bone and Vader ASAP.

I would hate to see cameras banned from Sanctus. I love seeing the photos on-line afterwards. Maybe we need something like a posted photo policy at the door, so people will have an idea of what is acceptable and what is not. I know it's not practical to ask permission to take a photo if there is a group of people in the shot, like of the dance floor. Things like "no upskirt photos" should be obvious, but that issue has come up before as well. If the photos are being taken for personal use or to be offered freely on-line or even sold for a KG approved charity, then I have no problems whatsoever. It's when some arrogant prick takes one without permission, slaps his copyright on it and offers it for sale to make a profit, all without obtaining a release that it's gone too far.

pretty much what scorptrio said - if you are in a public place than you can have you photo taken and as long as its reasonable photo then the photographer is clear, as far as taking pics of people and offering them for sale without obtaining a model release opens up an ugly can of worms - i agree with scorptrio on this one, i almost wish he had taken my photo so i could be the one to raise a stink about it

Hey sweetie,
He is right about the public thing. If it is outside of a building and in public, the law protects the photographer. However, if they were a good photographer, they would have told you that they will be for sale, and give you the option to say yes or no. And, kindly do what you ask, even though the photographer does not have to ask for your permission in an outside public situation.
I may be pursuing a degree in photojournalism, and for News photographers, this laws protects them. It is a good law, because if they weren't allowed to publish public photos, our newspapers would be empty and boring.
I am sorry you have experienced this. I will use this as a tool in the future and start asking people if they mind if I sale the photos. And out of courtesy, will not sell the ones that do not.
A photographer needs to earn a living for themselves and selling prints is one way to earn a living doing what the love the most. Maybe in the beginning he had no intention of selling the print, but the shot taken of you turned out so good, that he thought your shot would bring money in for him. Definatley take this as a compliment for sure! I am sure his intentions were not meant toward you in a negative way.

i understand that about news photography but i really dont think they can photograph individuals with the intent to sell for personal profit with out a model release

Actually, they can. Newspapers sell their photos they take that were published online or in print. They charge a lot more than his rate.

Thank you for the information and I agree that public photos should be used for journalistic purposes without having to obtain permission. However, the patio at Blue Cats isn't a public place - we all had to pay $5 to get in, making it a private club and not a public place. He's crossed the line here. I've PMed MizKitty about this, as most of the pictures are of her and I'm interested to know what she was told that night.

My husband is in the background of some of the mizkitty pics. He is annoyed that he can't even save pictures of himself. Greg, let me know what you find out from the photographer.

Exactly the point I was going to bring up. BlueCats was closed to the public that night unless you paid $5.

The patio at 11th Street is a public place. Market Square is a public place. Any place where admission is charged is not public.

Seriously tho, this sucks. These aren't even that good of pics. They're pretty much just normal pictures, except they're from sanctus' halloween. And they're charging $3 for it? I mean, yes, its only $3 bucks, but unless 2.75 is going towards a blowjob included with it, these fucks aren't getting my money.

Whoa,...OK? That was a bizarre statment about Mr. Shake..LOL. I think he originally started at Barleys.

You know, after I had made that comment about public places, I thought about the fact that it was private property on the patio. So you are right about that, it isn't public property then.

For the record, I come to most of the Gothic events and like to photograph the scene. I would love to sell prints in the future for profit, as I desparatley need a new camera. So, from now on, I will take photographs of you guys, but specifically get your permission to sell before I do it.

So if you see me take a pic of you, PLEASE feel free to tell me then, if it is ok for me to sell the print, otherwise I will hopefully soon have business cards to give out to each person I take a pic of, so that you can contact me and tell me if it is ok to sell the photo. That's one idea

Give me some feedback guys, I need it. I hope that you feel comfortable with me photographing the gothic events. Please know that I am a really easy going person, and will NOT be offended if I you do not want me to publish the photos online OR sell them. I am proud of the gothic community here in Knoxville, and hope that I am welcomed into the "Family". Beisides, Mother Mo and I went to highschool together, and am sure she will vouch for me!

I personally have no problem with people taking my picture and selling it, but I'd like to be told they are going to try to sell it, as you said Carie.

I like seeing people out and taking pictures. I like even more being able to browse through those pictures online. It would be great to have the option to purchase them if they are of high quality and interesting (which is how I think of most of Carie's photo's)

I was a bit appauled to see that the guy who was going around begging everyone for their picture to be taken was trying to sell them for 3 bucks on his site, and whoever said it, you're right, the pictures mostly suck.

BTW, Where are the rest of the photos from Sanctus? I'd really love to see them! I saw Carie's (Which were great, btw!) ..

hmmmm Where are the pictures from the burlesque show?

Oh man, I was irked that mine werent on the knoxpics site, but i can assure you if they had made it and he was selling pictures of my ass on the internet, someone would have gotten sued.

Blue Cats is a privately owned club, both clubs and the patio are on private property, as long as that private property did not ban camera at the event, taking pictures is fine. But if some takes pictures and sells without permission of another person, that is a completely different story and illegal.

I wouldn't ban camera's at sanctus. I realize that there have been occurances in the past of folks abusing their right to have them at our event, but these guys werent regular members of ANY community, they were just some creeps taking pictures. They were there the night before at the Freakers Ball just walkin.g past the line of people taking shots and handing out cards. But they went inside and annoyed the hell out of anyone at the Ball and at Sanctus. I think Kitty should definitely contact them about the shots. And anyone else these creepos are trying to exploit for money

Never thought I would see the daythat we might have to include a privacy disclosure at the door of blue cats to protect people patronizing events.

I took quite a few pictures at Sanctus and Bone downloaded them on his pc before we left to come back to Nashville. I haven't been able to find them on the forum, so I'm not sure he's had time to post them. If I get a chance, I'll get to a computer and get them up on the site.

I think Carie has handled this like the true professional she is. Being a professional artist and part time photographer, I can't stress how important it is to communicate to those being photographed, the nature of the situation though. The thought about business cards is perfect and it gets your name out there even more.

As far as the photos themselves, several of them are simply splendid and show a true eye for art and beauty. The black and whites are my favorites though. Hey you even got acouple pics of me (dork with the afgan hat)... I feel all warm and fuzzy.
If the majoity was wrong would it be right?
